ParkerVision Inc. announced Friday it lost the appeal of its patent infringement lawsuit against Qualcomm Inc.
Jacksonville-based ParkerVision was awarded a $173 million judgment by a jury in 2013, but it was overturned last year by the federal court judge presiding over the case. ParkerVision appealed to the U.S. Court of Appeals for the Federal Circuit in Washington, D.C., which heard arguments in May.
ParkerVision said Friday the appellate court affirmed the lower court's decision that ParkerVision did not prove infringement of its patents by Qualcomm.
ParkerVision has alleged Qualcomm has been illegally using the company’s patented wireless radio technology in its products.
The company last year filed a second lawsuit against Qualcomm, along with HTC Corp. and Samsung Electronics Co. Ltd., alleging infringement of a different set of patents. That case is scheduled for trial next year.
“We are highly disappointed with the appellate court's decision both with regard to infringement and validity of certain of our patent claims. Despite this setback, we will consider further options on appeal, and will move forward in our second infringement case against Qualcomm, HTC and Samsung,” CEO Jeffrey Parker said in a news release.
ParkerVision has been developing its technology for years, which it says improves the performance of wireless products. However, it has registered very few sales and has not recorded any revenue at all for several years.
Parker said in Friday's news release the company is continuing its efforts to sell its technology to manufacturers.
“We remain unwavering in our conviction that certain of our technologies have wide-spread applications in the industry and in our plans to continue to vigorously pursue the successful commercialization of those technologies through every means available to us,” he said.
