The subcontractor that painted structural steel at the flex field and amphitheater at TIAA Bank Field says it hasn’t been paid in full for work it performed and has filed a complaint against the prime contractor, two bonding companies and the Jacksonville Jaguars.
Arenas, Parks and Stadiums Solutions Inc. filed the breach of contract and collection action against Hunt-Danis, Hunt-Danis Construction Group Inc., Danis Construction LLC, Federal Insurance Co., Travelers Casualty & Surety Co. of America and the Jaguars.
According to the complaint, the prime contractor entered into a $350,000 agreement to paint and finish steel joints, bolts and other structures.
The company says it was paid $283,500 after the initial scope of the contract was completed and that an invoice for the $66,500 balance was submitted, but remains unpaid.
APS states in the complaint that during the course of the project, it was “authorized and required” to perform additional work, including painting, finishing and other “touch-ups” in order to correct damages to the steel caused by other subcontractors.
The company states that the prime contractor for Dream Finders Homes Flex Field at Daily’s Place and the Daily’s Place amphitheater requested APS to submit change orders in the amounts of $118,512.83 and $219,983.83 that increased the total amount of the agreement to $688,496.66, leaving a current unpaid balance of $404,966.66.
APS also states that during the course of the projects, authorized agents of the prime contractor acknowledged receipt and acceptance of the subsequent invoices and “repeatedly assured APS that payment was forthcoming.”
Federal and Travelers issued a $53.25 million payment bond in December 2016 for the project. According to the complaint, APS Solutions provided Federal and Travelers with written notice of a bond claim that has not been paid.
According to case documents available from the Duval County Clerk of Courts, only defendant Travelers Casualty has filed an answer to the complaint challenging its merit and denies that any sums are due in connection with the bond claim.
