Legislation puts court clerks on clock

The bill, effective July 1, requires clerks to electronically transmit specified documents within six hours.

Effective July 1, court clerks will be required to electronically transmit specified petitions, notices of hearings, summons and orders within a six-hour time frame, including orders for involuntary examination under the Baker Act, involuntary services under the Marchman Act and risk protection orders.

The legislation closes a gap in the law exposed by a Thanksgiving 2024 incident in Ormond Beach. A delay in delivering an ex parte order snowballed into an armed six-hour standoff between law enforcement and a military veteran experiencing a mental health crisis that ended with the man being shot to death by a Volusia County Sheriff’s Office SWAT team sniper.
