Today a criminal history record search may be performed for many reasons.  Potential employers may perform a search before extending an employment offer. Additionally, public schools may perform a search before allowing a parent to volunteer in the classroom or chaperone a field trip.

A criminal history record showing charges were not filed or charges were dismissed by the state attorney or statewide prosecutor may be sealed or expunged under certain circumstances. 

Criminal history records relating to certain crimes are not eligible for sealing or expunction. Some, but not all, of these crimes include sexual battery, sexual abuse of the elderly or disabled persons, prostitution and communications fraud.

Persons who have secured a prior sealing or expunction of a criminal history record under Florida law are not eligible.

Sealing or expunction takes several months. However, with the help of a knowledgeable attorney, the process can be affordable and worthwhile.
