Appeal filed in Regency Square Mall foreclosure judgment

Property owners ask court to postpone the March 21 public auction.

The owners of Regency Square Mall filed an emergency motion Wednesday to postpone the foreclosure auction of the mall scheduled at 11 a.m. March 21.

On Feb. 5, 4th Circuit Judge Kevin Blazs signed an amended final judgment of foreclosure against the property owners and in favor of JAAMM Inc., a company that intended to open an automobile and motorcycle museum inside the mall.

Regency Mall Realty LLC, Regency CH LLC and Regency Nassim LLC, subsidiaries of mall owners Namdar Realty Group LLC and Mason Asset Management, informed the court in the motion that a challenge of the final judgment was filed Feb. 28 in the 1st District Court of Appeal in Tallahassee.

After performing more than $135,000 of work in the space JAAMM leased to repair the roof and electrical system and filing a mechanic's lien when the mall owners refused to reimburse the repair cost.

The final judgment of foreclosure was for $162,872.62, the amount of the mechanic's lien plus attorney fees and costs.

The auction remained listed Thursday morning on the Duval County Clerk of Courts' Real4close system.

“We fully expect the sale will proceed. We just want to get paid,” said Michael Duncan, JAAMM's attorney.
